What happens if nothing is in place.

Not to alarm you. This is simply what Virginia law does in the absence of instructions, and every part of it is straightforward to prevent.

Virginia decides who inherits

The intestacy statutes set a fixed order of inheritance, and the court follows it, whether or not it reflects what you would have chosen. They make no allowance for a stepchild you raised, an unmarried partner, a promise made to one child, or a cause that mattered to you. If you have young children, the court also decides who will raise them.

If you cannot speak for yourself

No one has automatic authority

Without a durable power of attorney and an advance medical directive, there is no guarantee that someone can step in to manage your finances or make medical decisions, not a spouse, not an adult child. The alternative is a guardianship or conservatorship petition, which means going to court at the point your family is least able to take it on.

WHY IT MATTERS HERE

Loudoun County families plan differently, and for good reason.

A few patterns come up again and again in Ashburn that we see far less often elsewhere in Virginia.

  • Your house is probably your largest asset

    Loudoun has some of the highest property values in the country. When a home makes up most of an estate, probate stops being a formality and starts being expensive and slow. That is usually the argument for a revocable living Trust rather than a Will alone.

  • Federal and contractor benefits need their own attention

    Thrift Savings Plan accounts, FEGLI, FERS survivor elections, and contractor retirement plans all pass by beneficiary designation, not by your Will. We check those designations against your plan rather than assuming they line up.

  • Young families with minor children

    Much of Ashburn is families in their thirties and forties. The pressing questions are guardianship and how an inheritance is managed for a child who is still years away from handling it — not estate tax.

  • Business owners and equity holders

    If you own a share of a business, your operating agreement and your estate plan have to agree with each other. When they do not, the family and the business both suffer.

  • Property on both sides of a state line

If someone has already passed

Probate & Estate Administration

For someone who lived in Ashburn, the estate is opened with the Clerk of the Loudoun County Circuit Court in Leesburg. Two dates matter early on: an inventory of the estate is due to the Commissioner of Accounts within four months of qualification, and smaller estates may be able to avoid full administration altogether using the small estate procedure.

If there is no Will, Virginia's intestacy rules decide who inherits, and they rarely match what the family expected.

Estate planning in Ashburn and Loudoun County.

Do I need a Trust, or is a Will enough?

It depends mostly on what you own and how you want it handled. A Will directs who receives your property, but it does so through probate. In Loudoun County, where a house is often the largest thing in an estate, a revocable living Trust can keep the home out of probate entirely and save your family months of court process.

For a younger family renting or early into a mortgage, a well-drafted Will with the right guardianship provisions is frequently sufficient. We will tell you honestly which one your situation calls for.

Do you actually have an office in Ashburn?

Yes. Our office is at 44927 George Washington Boulevard, Suite 120, with free parking outside and step-free access. Several firms that advertise for Ashburn estate planning work are based elsewhere in Northern Virginia and travel in. Ashburn is one of our two offices, and you can meet us here as many times as your plan needs.

Where is probate filed for someone who lived in Ashburn?

With the Clerk of the Loudoun County Circuit Court in Leesburg. An inventory of the estate is then due to the Commissioner of Accounts within four months of qualifying as executor or administrator (Va. Code § 64.2-1300). Smaller estates may qualify for Virginia’s small estate procedure and avoid full administration (Va. Code § 64.2-601).

Does Virginia have an estate tax?

No. Virginia does not impose a state estate tax or inheritance tax. Federal estate tax applies only above the federal exemption, which for 2026 is $15 million per person and $30 million per married couple. For the large majority of Loudoun families, estate tax is not the concern — probate, incapacity, and guardianship.

Can you help if I own property in both Virginia and West Virginia?

Yes. We are licensed in Virginia and West Virginia, so a single plan can address property in both states. That matters if you hold a vacation home, inherited farmland, or family property across the line, because real estate is governed by the law of the state it sits in.

How long does it take, and how much does it cost?

Most estate plans move from the first meeting to signing in three to five weeks, depending on how quickly decisions are made and how complex the assets are. We quote a flat fee before any drafting begins, so you know the cost up front rather than watching an hourly clock.
